Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Geekflare website, including any content, functionality, and services offered on or through geekflare.com (the "Website"), and all related products, including our APIs, Tools, and Guides (collectively, the "Services").

The Services are operated by Geekflare LTD ("Geekflare", "we", "us", or "our"), a company registered in England and Wales under company number 12085510.

Our AI workspace is now provided as Sparkian at sparkian.com, operated by the same company trading as Sparkian. Use of Sparkian is governed by the Sparkian Terms of Service and its own privacy, cookie and acceptable use policies.

Please read the Terms carefully before you start to use the Services. By using the Services or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy. If you would rather not agree to these Terms or the Privacy Policy, you must not access or use the Services.

1. Changes to the Terms of Service

We may revise and update these Terms occasionally in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

2. General Terms

These terms apply to all users of any part of the Geekflare Services.

2.1. Accessing the Services and Account Security

We reserve the right to withdraw or amend our Services, in our sole discretion without notice. To access some Services, you may be asked to provide registration details. It is a condition of your use that all information you provide is correct, current, and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

2.2. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Geekflare, its licensors, or other providers of such material. They are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal or internal business use only. You must not reproduce, distribute, modify, create derivative works of, republish, download, store, or transmit any of the material on our Website, except as it is an automatic result of your browser's caching or as explicitly permitted via our API outputs.

2.3. Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way.
  • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms.
  • To impersonate or attempt to impersonate Geekflare, a Geekflare employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Geekflare or users of the Services.

2.4. User Contributions

The Website may contain message boards, comment sections, and other interactive features that allow users to post content. Any User Contribution you post will be considered non-confidential and non-proprietary. By providing any User Contribution, you grant us and our affiliates a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content.

2.5. Content Accuracy

We strive to provide accurate and helpful information in our Guides and Articles. Our articles undergo a review process including proofreading and editorial checks. While we aim for high accuracy, occasional errors may occur. We appreciate your help in keeping our information reliable. If you notice any error or have suggestions, please contact us.

2.6. Fees and Payments

Geekflare uses third-party payment processors (such as Stripe) to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms.

Geekflare, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

2.7. Refund Policy

We have a no-refund policy in place. In exceptional circumstances, we may review refund requests on a case-by-case basis. Please reach out to discuss your situation.

2.8. Links

Geekflare has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Geekflare of the site. Use of any such linked site is at your own risk.

2.9. Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

2.10. Sanctions and Export Policy

You may not use any Geekflare Service if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using the Services.

2.11. Bring Your Own Key (BYOK)

Where a Service lets you connect your own third-party account (for example an OpenAI or Anthropic API key):

  • You are responsible for maintaining the validity and funding of that third-party account.
  • You agree to abide by the terms of service of the underlying provider.
  • Geekflare is not liable if your third-party key is banned, restricted, or throttled as a result of your usage patterns or the content you generate through our platform.
  • Your keys are encrypted at rest and are used only to make requests on your behalf. You can remove a key from your account at any time.

3. Terms Specific to Geekflare Tools

If you use any of Geekflare tools, the following terms apply.

3.1. Permitted Use

You may only use the Tools to test and analyze systems and websites that you have explicit authorization to assess. Using our Tools for malicious purposes, to attack systems, or to scan third-party infrastructure without permission is strictly prohibited and may be illegal.

3.2. "As Is" Basis

The Tools and their results are provided on an "as is" and "as available" basis. We do not guarantee that the information provided is exhaustive, accurate, or up-to-date. You are responsible for interpreting the results and taking appropriate action.

4. Terms Specific to Geekflare API

If you use any Geekflare API, the following terms apply.

4.1. API License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to use the API to develop applications that interface with our Services.

4.2. API Keys and Security

You will be issued a unique API key for accessing the API. You are solely responsible for maintaining the security of your API key. Do not share it with any unauthorized third party. You are responsible for all requests made with your API key.

4.3. Usage, Rate Limits, and Fees

Your use of the API may be subject to usage limits (rate limits) and fees. These limits and any applicable pricing will be specified on our API documentation or pricing page. We reserve the right to change our fees or rate limits with reasonable notice.

4.4. API Restrictions

You agree not to:

  • Use the API to create a product or service that competes directly with Geekflare.
  • Use the API in a manner that, in our sole discretion, constitutes abuse or excessively frequent calls.
  • Obscure or hide your application's identity when using the API.

4.5. Target Website Compliance (Web Data Extraction)

If using the Geekflare API for web data extraction or scraping:

  • You are solely responsible for ensuring that your use of the API to access third-party websites complies with the Terms of Service, robots.txt directives, and copyright laws applicable to those third-party websites.
  • You strictly agree not to use the API to extract sensitive Personal Identifiable Information (PII), bypass authentication mechanisms like paywalls, secure login portals, or conduct malicious activities like DDoS attacks or overwhelming target servers.
  • You must comply with all applicable data privacy laws such as GDPR, CCPA, or equivalent regarding any data you extract and process using our services.
  • Geekflare acts solely as a data processor and infrastructure provider similar to a web browser. We disclaim all liability for any blocks, bans, or legal actions taken against you by third-party website owners resulting from your data extraction activities.

5. Acceptable Use Policy

This acceptable use policy covers the products, services, and technologies provided by Geekflare under any ongoing agreement. It is designed to protect us, our customers, and the wider Internet community from unethical, irresponsible, and illegal activity. It forms part of these Terms.

Customers found engaging in activities prohibited by this policy may have their access suspended and their account terminated. In serious cases we may be legally obliged to report the activity to the relevant authorities.

5.1. Fair use

We provide our facilities with the assumption your use will be "business as usual", as per our offer schedule. If your use is considered to be excessive, then additional fees may be charged, or capacity may be restricted.

We are opposed to all forms of abuse, discrimination, rights infringement, and any action that harms or disadvantages any group, individual, or resource. We expect our customers and, where applicable, their users ("end-users") to engage our products with similar intent.

5.2. Customer accountability

We regard our customers as responsible for their own actions and for the actions of anyone using our products with the customer's permission. This responsibility also applies to anyone using our products on an unauthorized basis as a result of the customer's failure to put in place reasonable security measures.

By accepting products from us, our customers agree to ensure adherence to this policy on behalf of anyone using the products as their end-users. If a customer or their end-user violates this policy, we reserve the right to terminate any products associated with the offending account or the account itself, or to take any remedial or preventative action we deem appropriate, without notice.

5.3. Prohibited activities

You must not use the Services, or allow anyone else to use the Services, to:

  • Break the law, or help another person break the law.
  • Generate, request, store, or distribute child sexual abuse material in any form, or any content that sexualises a minor. We report this activity to the relevant authorities.
  • Harass, threaten, defame, or incite violence against any person or group, or promote hate speech or discrimination.
  • Send unsolicited bulk messages, phishing, or any other form of spam, or harvest contact details for that purpose.
  • Create, distribute, or command malware, ransomware, botnets, or any other malicious code.
  • Infringe copyright, trademark, database, trade secret, or any other intellectual property right.
  • Collect, process, or resell personal data unlawfully, including special category data as defined by the UK GDPR and the EU GDPR.
  • Misrepresent your identity, impersonate any person or organisation, or obscure the origin of your traffic to evade a block or a rate limit.
  • Resell, sublicense, or redistribute the Services, or use them to build a product that competes directly with Geekflare.

5.4. Systems, networks, and target websites

Our APIs and Tools reach systems that belong to other people. You may use them only against systems you own or have explicit permission to assess, and you must not:

  • Scan, probe, or test the security of a system without the owner's authorisation.
  • Attempt a denial-of-service attack, or send volumes of traffic that degrade a target's service.
  • Bypass authentication, paywalls, or any access control, or defeat a measure a site uses to restrict automated access beyond the ordinary operation of our Services.
  • Circumvent our own rate limits, credit accounting, or account restrictions, or probe our infrastructure for vulnerabilities outside a channel we have invited you to use.

You are responsible for ensuring that your use of the Services against a third-party website complies with that website's terms, its robots.txt directives, and the laws that apply to it.

5.5. Enforcement and reporting

Where we can, we will contact you before acting and give you a reasonable opportunity to resolve the issue. If the activity is serious, ongoing, or exposes us or a third party to risk, we may suspend or terminate access immediately and without notice. Suspension for a breach of this policy does not entitle you to a refund.

If you believe someone is using our Services in breach of this policy, please tell us through our contact page with enough detail for us to investigate.

6. General Legal Provisions

6.1. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER GEEKFLARE NOR ANY PERSON ASSOCIATED WITH GEEKFLARE MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

6.2. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL GEEKFLARE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

6.3. Indemnification

You agree to defend, indemnify, and hold harmless Geekflare, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services.

6.4. Governing Law and Jurisdiction

All matters relating to the Services and these Terms, and any dispute or claim arising therefrom, shall be governed by and construed in accordance with the internal laws of the United Kingdom without giving effect to any choice or conflict of law provision.

6.5. Waiver and Severability

No waiver by Geekflare of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

6.6. Entire Agreement

These Terms of Service, including the Acceptable Use Policy in section 5, together with our Privacy Policy and Cookie Policy, constitute the sole and entire agreement between you and Geekflare regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

This website is operated by Geekflare LTD. All feedback, comments, requests for technical support, and other communications relating to the Services should be directed through our contact page.
